Terms of Service

These terms ("Terms") govern your use of WindUp, the apps for iPhone, Android, Apple Watch and Wear OS and the windup.live website operated by Virtual Verse Studio. By using WindUp you agree to these Terms.

1. The service

WindUp provides live wind alerts and forecasts based on data from third-party weather stations and providers, and lets you record sessions on your watch and share them with other riders. We do not own the underlying wind data and we make no guarantee of accuracy, timeliness, or fitness for any particular use.

2. Safety disclaimer

WindUp is a convenience tool, not a safety system. Always cross-check live data with on-site observation, official forecasts and your own judgement before any wind-dependent activity. We accept no liability for decisions made based on WindUp data. Session figures such as jump height, speed and heart rate are estimates from your watch's sensors, not medical advice.

3. Account & conduct

You're responsible for keeping your account secure and using WindUp lawfully. Don't try to disrupt the service, reverse-engineer the app, or scrape the data feeds.

4. Community

Keep what you post respectful and lawful. Don't post spam, harassment, hate, nudity or sexual content, violence, or content that impersonates someone or that you don't have the right to share. There is no tolerance for objectionable content or abusive users. You can report a rider, a session or a comment, and block a rider, in the app. We review reports and may remove content, or suspend or ban accounts, that break these Terms.

5. Your content

You keep ownership of the sessions, photos, comments and other content you add to WindUp. You give Virtual Verse Studio a worldwide, non-exclusive, royalty-free licence to store, copy, display and process that content as needed to run WindUp, including showing your public content to other riders according to your privacy settings. The licence ends when you delete the content or your account, except for copies other riders have already shared.

6. Free features and WindUp Pro

WindUp's core features are free, and the core live alarm will stay free. WindUp Pro is an optional auto-renewing subscription that adds more features, as described in the app. Prices and billing periods are shown in the app before you buy and may vary by country.

• Payment is charged to your Apple Account or Google Play account when you confirm the purchase.
• Your subscription renews automatically at the end of each period unless you cancel it. On the App Store, cancel at least 24 hours before the period ends; your account is charged for the renewal within the 24 hours before it ends.
• Manage or cancel it at any time in your App Store or Google Play account settings. Deleting your WindUp account does not cancel it.
• An introductory price, when offered, applies to new subscribers for the period shown in the app.
• Refunds are handled by Apple or Google under their policies.

Gusts you earn in the app can be spent on WindUp Pro for yourself or a friend. They have no cash value and can't be sold or exchanged for money.

7. Intellectual property

WindUp, the WindUp logo, and the app code are owned by Virtual Verse Studio. The wind data is owned by the stations and providers we integrate with.

8. Limitation of liability

To the maximum extent permitted by law, Virtual Verse Studio is not liable for any indirect, incidental, consequential or special damages arising from your use of WindUp.

9. Termination

We may suspend or terminate accounts that violate these Terms, with or without notice. You can stop using WindUp and delete your account at any time in the app.

10. Changes

We may update these Terms occasionally. The "Last updated" date reflects the latest revision. Continued use after changes counts as acceptance.
